These Terms of Service ("Terms") govern your access to and use of Gameorbitx (the "Site" or "Service"). Please read them carefully. By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.

1. The Service

Gameorbitx is a free, mobile-friendly HTML5 game portal. We provide a catalog of browser games, category browsing, search, editorial collections (such as Trending Now and Editor's Pick), game detail pages (About, How to Play, Tips, FAQ), and in-browser play through embedded game frames. Games are hosted by third-party publishers; we act as a directory and launcher, not as the game developer unless stated otherwise.

2. Eligibility

The Site is intended for a general audience. If you are under 18, you may use the Site only with the permission and supervision of a parent or legal guardian. By using the Site, you represent that you have the legal capacity to enter into these Terms or that your parent or guardian has accepted these Terms on your behalf.

3. No accounts

We do not offer registration, login, profiles, or cloud saves. Favorites and recent-play history are stored in your browser's local storage on your device only. You are responsible for that data if you share a device or clear browser storage. We cannot recover deleted local data.

4. Editorial content and rankings

Star ratings, play counts, leaderboard rows, "Top Rated This Week," and similar labels are curated or generated editorially for discovery. They are not user reviews, verified player statistics, gambling odds, or guarantees of quality, safety, or availability. Game descriptions, tips, and FAQ content are provided for convenience and may contain errors or become outdated.

5. Acceptable use

You agree to use the Site lawfully and in good faith. You must not:

• Violate any applicable federal, state, or local law or regulation
• Harass, threaten, or harm others, or attempt to access non-public areas of the Site
• Scrape, crawl, harvest, or bulk-download the catalog, metadata, or assets without our prior written consent
• Reverse engineer, decompile, or attempt to extract source code except as permitted by law
• Interfere with or disrupt the Site, servers, or networks (including denial-of-service attacks, malware, or automated abuse)
• Circumvent security, rate limits, or access controls
• Misrepresent your affiliation with Gameorbitx or any game publisher
• Use the Site to distribute spam, unlawful content, or infringing material

We may suspend or block access for conduct we reasonably believe violates these Terms or poses risk to the Site or others.

6. Third-party games, ads, and links

Embedded games, advertisements, and external links are provided by third parties. Their terms, privacy policies, age restrictions, in-game purchases, and data practices apply when you interact with them. We do not control third-party content and are not responsible for errors, outages, data collection, or conduct within embedded games or linked sites.

We may add, remove, or reorder games in the catalog at any time without notice.

7. Intellectual property

The Site layout, branding, original text, and editorial organization are owned by Gameorbitx or our licensors and are protected by copyright, trademark, and other intellectual property laws. Game titles, icons, artwork, and embedded software belong to their respective publishers.

You may not copy, modify, distribute, or create derivative works from the Site or its content except for personal, non-commercial browsing or as permitted by law.

8. Copyright complaints (DMCA)

We respect intellectual property rights. If you believe content on the Site infringes your copyright, send a notice to our designated agent at support@gameorbitx.top with the subject DMCA Notice, including:

• Your physical or electronic signature
• Identification of the copyrighted work claimed to have been infringed
• Identification of the material on the Site that you claim is infringing, with enough detail for us to locate it (URL preferred)
• Your contact information (address, telephone number, and email)
• A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law
• A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf

We may remove or disable access to material identified in a valid notice and may terminate repeat infringers where appropriate. Misrepresentations may expose you to liability under 17 U.S.C. § 512(f).

If you believe material was removed in error, you may submit a counter-notification consistent with the DMCA to the same contact address.

9. Feedback

If you send suggestions, bug reports, or other feedback, you grant us a non-exclusive, royalty-free, perpetual, worldwide license to use that feedback to operate and improve the Site without obligation to you.

10. Disclaimers

THE SITE AND ALL GAMES, CONTENT, AND FEATURES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, secure, or compatible with every device or browser; that game embeds will always load; or that editorial information is complete or accurate.

Some jurisdictions do not allow certain warranty exclusions; in those jurisdictions, the above exclusions apply to the fullest extent permitted by law.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Gameorbitx AND ITS OWNERS, OPERATORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE OR ANY THIRD-PARTY GAME OR AD.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE WILL NOT EXCEED THE GREATER OF (A) USD $50 OR (B) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (TYPICALLY ZERO BECAUSE THE SITE IS FREE).

Some states do not allow limitation of incidental or consequential damages; in those states, our liability is limited to the greatest extent permitted by law.

12. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Gameorbitx and its operators from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site, violation of these Terms, or infringement of any third-party right.

13. Governing law and disputes

These Terms are governed by the laws of the United States and applicable state law, without regard to conflict-of-law rules. You agree to first contact us at support@gameorbitx.top to try to resolve any dispute informally.

Where permitted by law, you and Gameorbitx agree that exclusive jurisdiction for disputes relating to these Terms or the Site will be in the state or federal courts located in the United States, and you consent to personal jurisdiction in those courts.

14. Export compliance

You represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. government list of prohibited or restricted parties.

15. Changes to these Terms

We may modify these Terms at any time. We will post the updated version on this page and change the "Last updated" date. Material changes may be highlighted on the Site where practicable. Your continued use after changes become effective constitutes acceptance. If you do not agree, stop using the Site.

16. Severability and waiver

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect. Our failure to enforce any right or provision is not a waiver of that right or provision.

17. Entire agreement

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Gameorbitx regarding the Site and supersede prior agreements on that subject.
